Civil Liability Act 2003 (Qld)
The Act reforms the law of civil liability for negligent acts in Queensland and applies to claims for damages for harm. The Act also implements a proportionate liability regime for claims concerning purely economic loss and property damage, so that a defendant will not be primarily liable to the plaintiff for more than their own share of responsibility for the loss that a plaintiff has suffered. Unlike comparative regimes in New South Wales, Victoria, Western Australia and the ACT, the CLA specifically prohibits parties from contracting out of the regime.
